1. Acceptance of terms

By downloading, installing, or using YPlus (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Service.

Refunds

Because payments are handled by Apple, Google, or Stripe, refund requests must be submitted directly to the respective platform through their standard processes. We cannot issue refunds directly.

You agree to use the Service only for lawful educational purposes. You must not:

7. Your data and content

You retain full ownership of all class, student, and attendance data you enter into the Service. We do not claim any intellectual property rights over your content.

You grant us a limited, non-exclusive, royalty-free licence to store, process, and transmit your data solely to the extent necessary to provide the Service (e.g. cloud backup and sync).

You are responsible for ensuring that your collection and storage of student data complies with applicable laws and your institution's policies.

8. Data and privacy

Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you agree to the Privacy Policy.

9. Intellectual property

All rights, title, and interest in and to the Service (excluding your content) are and remain the exclusive property of YPlus. These Terms do not grant you any right to use YPlus's name, logos, or trademarks.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. You use the Service at your own risk.

Because YPlus is offline-first, local data persistence is the primary guarantee. Cloud backup is a supplementary feature and should not be treated as your sole backup mechanism. We strongly recommend maintaining independent backups of critical attendance records.

11. Limitation of liability

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR €50, WHICHEVER IS GREATER.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable EU consumer protection law.

12. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for material changes where possible. We are not liable to you for any modification, suspension, or discontinuation of the Service.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you via an in-app notice or email at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes your acceptance of the revised Terms.

14. Termination

You may stop using the Service and delete your account at any time from Settings → Delete All Data, or by emailing [email protected].

We may suspend or terminate your account immediately if you violate these Terms. Upon termination, your right to use the Service ceases. Data deletion is governed by our Privacy Policy.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of Cyprus, without regard to its conflict-of-law provisions.

Any dispute arising from these Terms or the Service shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts of Cyprus.
